Terms of Service

By commissioning artwork from Montana — Verdant Palette (“the Artist,” “I,” “me”), you (“the Client”) agree to the following Terms of Service.


1. General Agreement


By purchasing or commissioning artwork, the Client confirms that they have read, understood, and agreed to these Terms of Service in full. These terms apply to all commissions unless otherwise stated in writing.


2. Commission Scope & Process

• Commissions are created based on the information, references, and descriptions provided by the Client.

• The Client is responsible for supplying clear and accurate references.

• The Artist will check in throughout the process to confirm direction, progress, and satisfaction.

• Significant changes to the original concept after work has begun may result in additional fees or may be declined at the Artist’s discretion.


3. Payment Terms

• 100% payment is required upfront before work begins.

• For large or complex projects, payment agreements or payment plans may be arranged at the Artist’s discretion and must be agreed upon in writing before work begins.

• No work will begin until payment is completed according to the agreed terms.

• All prices are listed in USD unless otherwise stated.


4. Revisions

• Minor revisions are included and may be requested during the sketch or early refinement stages.

• The Artist will actively check in with the Client to verify accuracy and direction.

• Major revisions, excessive changes, or changes that significantly alter the approved concept may incur additional fees or be declined.


5. Refunds & Cancellations

• Refunds are reflective of the amount of work completed at the time of cancellation.

• If the Client cancels:

• 0% completed → 100% refund

• 50% completed → 50% refund

• Near completion or completed → no refund

• If a partial refund is issued, the Client will receive the incomplete work corresponding to the completed percentage.

• If the Artist cancels the commission, a full refund will be issued.


6. Turnaround Time

• Turnaround time varies depending on complexity and current workload.

• Estimated timelines will be communicated before work begins.

• Delays due to illness, emergencies, or unforeseen circumstances will be communicated promptly.


7. Usage Rights & Copyright

• Commercial use and copyright are included in all commissioned works sold.

• Upon completion and full payment:

• The Client owns the copyright to the commissioned artwork.

• The Client may use the artwork for both personal and commercial purposes.

• The Artist retains the right to display the artwork for:

• Portfolio use

• Social media

• Website display

• Promotional or marketing purposes

• When sharing commissioned work, the Artist will credit the Client where appropriate.


8. Credit

• The Client may not claim authorship of the artwork.

• Altering or removing the Artist’s signature is not permitted unless agreed upon in writing.

• Credit to the Artist is appreciated when possible, especially in public or commercial use.


9. Prohibited Use


The artwork may not be used for:

• Hate speech, harassment, or illegal activities

• AI training, machine learning datasets, NFTs, or blockchain-related uses unless explicitly agreed upon in writing

• Misrepresentation of the artwork’s creator


10. Artist Rights

• The Artist reserves the right to refuse or cancel any commission at their discretion.

• Style consistency is based on the Artist’s existing portfolio; exact replication of another artist’s style is not guaranteed.

• The Artist is not responsible for dissatisfaction caused by unclear references or late changes.


11. Liability

• The Artist is not responsible for any damages, losses, or claims arising from the use of the commissioned artwork.

• All artwork is provided “as is.”


12. Agreement


By commissioning artwork from Montana — Verdant Palette, the Client acknowledges and agrees to all terms outlined above.
